March 28, 2024In the ongoing legal battle between the African National Congress (ANC) and the
uMkhonto weSizwe Party (MKP), the latter’s lawyers have argued that suggesting
voters could confuse the two parties is an insult to the electorate. The ANC is seeking to
compel the MKP, headed by former president Jacob Zuma, to change its name and
logo, claiming trademark infringement.
During the court proceedings, advocate Dali Mpofu, representing the MKP, questioned
whether calling the party “Mkhonto kaZuma” would suffice to differentiate it from the
ANC’s historical military wing, Umkhonto weSizwe. The MKP’s legal team contends that
voters possess the necessary discernment to distinguish between the two political
entities, rendering the ANC’s concerns about potential confusion unfounded and
insulting to the electorate’s intelligence.
