March 22, 2024Nosiviwe Mapisa-Nqakula, the National Assembly speaker on special leave, has filed court papers to prevent her potential arrest by the National Director of Public Prosecution Shamila Batohi, Police Minister Bheki Cele, and investigators. The papers request access to the entire investigative file related to the case under CAS 176/2024, including witness statements and investigator notes.
Mapisa-Nqakula’s legal challenge comes amidst speculation of her arrest following a raid at her home on Tuesday by the Investigating Directorate. The raid is linked to allegations that she solicited bribes worth millions of rands from a defence contractor between 2017 and 2019 while serving as defence minister. Mapisa-Nqakula has maintained her innocence and denied any wrongdoing but took special leave to protect Parliament’s integrity.
In her affidavit, Mapisa-Nqakula argues that the interdict and request for investigative materials do not impede law enforcement functions as she intends to prove her innocence. Her objective is to highlight potential issues and irregularities in the case against her, including what she calls false allegations about agreeing to present herself at a police station.
